Portsmouth City Council (the 'Council') is awarding a contract to for the supply, installation and commissioning of a Gottwald HMK 6507 Mobile Harbour Crane form Konecranes (the 'Supplier') for use at Portsmouth International Port (the 'Port'). The Port is wholly owned and directly operated by the Council. The crane will be used by Portico which operate a deep water cargo terminal located within the Port. Portico is a private limited company which is wholly owned by the Council. The Council will enter into contract with the Supplier on 12.11.2019 to the value of 3 594 995 EUR in order to enable delivery, installation and commissioning by March 2020. Portsmouth City Council (the 'Council') is awarding a contract to for the supply, installation and commissioning of a Gottwald HMK 6507 Mobile Harbour Crane form Konecranes (the 'Supplier') for use at Portsmouth International Port (the 'Port'). The Port is wholly owned and directly operated by the Council. The crane will be used by Portico which operate a deep water cargo terminal located within the Port. Portico is a private limited company which is wholly owned by the Council. The Council will enter into contract with the Supplier on 12.11.2019 to the value of 3 594 995 EUR in order to enable delivery, installation and commissioning by March 2020. Portico is preparing to handle vessels with a greater beam and larger and more heavier cargo which will require tandem lifts with a greater radius than the current operation. In order to safely and efficiently undertake this operation 2 cranes run in 'tandem mode' with a similar radius must be used so that dual simultaneous operation by one crane operator can be achieved. This mode of operation requires that both cranes are running on the same operating system and can only be conducted safely where both cranes are of the same model and specification. If this is not the case unacceptable safety risks associated with differing performance in respect of unequal loads, lateral pull, overturning moments and fluctuating speeds could be incurred. Furthermore, where 2 cranes are used to handle a single lifting operation the safe working load must be reduced by 25 % from specified maximum capacity as set out within the lifting operations and lifting equipment Regulations 1998 (LOLER). However, where both cranes are operated in tandem by a single operator using the same operating system both cranes can be used to their specified maximum capacity. Portico already have a Gottwald HMK 6507 Mobile Harbour Crane in operation at their site which will be used in tandem mode with the new crane of the same model. As the 2 cranes will be subject to the same operating system and have the same performance specifications the cranes will be able to be operated effectively by a single operator and can be operated to their specified maximum loading capacity. The Supplier is the sole Supplier of this model of crane as they own the Gottwald brand and do not sell the required plant to any other Suppliers. In view of the above the Council is of the view that in accordance with Regulation 32 (2) (b) (ii) of the Public Contracts Regulations (2015) that competition in this particular is 'absent for technical reasons' and will enter into contract with the Supplier via use of the 'Negotiated Procedure without Prior Publication' as set out within Regulation 32.
