Jf. folkeskolelovens § 19j kan kommunalbestyrelsen indgå overenskomst med en institution, der udbyder erhvervsuddannelse, om at varetage 10. klasseundervisning, herunder EUD10 på vegne af kommunalbestyrelsen. Det vil sige at undervisningsinstitutioner, der kun har gymnasiale uddannelser, ikke alene kan drifte 10. klasse.
