Description

The State Laboratory intend to invoke Article 32 for a derogation from tendering for the purchase of a GC-HRMS system for the quantitative analysis of dioxins, furans, polychlorinated biphenyls (PCBs) and brominated flame retardants (BFRs) in a variety of food and feed matrices. The system must match the performance criteria relating to confirmatory methods of analysis (as outlined in the Commission Regulation EC 152/2009 and EC 1883/2006 and as amended) and must be capable of determining these compounds within established maximum limits (Commission Regulation EC 1881/2006, Commission Directive 2006/13/EC and as amended). Market research undertaken by the State Laboratory, including testing of instrumentation, shows there is only one technology capable of these analyses in these matrices. There is only one supplier of this technology to Ireland. Competition is absent for technical reasons which is a case provided for in Section 2 (b) (ii) of Article 32 of Directive 2014/24/EU.
